The General Data Protection Law was created in 2018 and came into force in 2020. However, it is only from this year, 2023, that LGPD fines will be applied to companies that do not comply with data privacy and security policies and violate the rules.

Are LGPD fines already in effect? ​​Who can be fined?
The National Data Protection Authority (ANPD) has already approved the Regulation on Dosimetry and Application of Administrative iran number dataset and published Resolution CD/ANPD No. 4 in the Official Gazette of the Union, on February 24, 2023.

This resolution provides for fines and sanctions for those companies that do not follow the rules set out in the Law, regarding security and data protection.

It is the ideal world. But for those who do not understand this message, our inspection will be ready to act."

Understand what the fines and penalties are
The purpose of every law is to ensure that the rules are followed, and when this is not the case, those who fail to comply are subject to penalties, and the LGPD is no different. In fact, fines and sanctions are already in effect and may even be retroactive!

These criteria include: the degree of damage caused ; the advantage sought by the offender; recidivism ; in addition to the good faith of the offender and the severity and nature of the infractions and the personal rights that were affected.
